The former Chief Security Officer to the late General Sani Abacha, Major Hamza Mustapha alleged to have masterminded the killing of Alhaja Kudirat Abiola has been on trial for a while
A Lagos High Court, sitting at Igbosere Lagos, Southwest Nigeria ordered Al-Mustapha, the driver of the late Kudirat, Lateef Shofolahan to enter their defence while the third accused person, CSP Rabo Lawal, the then head of Mobile Police Force Unit, Aso Rock was acquitted and discharged.
In prosecuting the accused persons, the Director of Public Prosecution DPP of Lagos State, Olabisi Odugbesan called three prosecuting witnesses, Sergeant Barnabas Jabila a.k.a. Sergeant Rogers, Mohammed Abdul alias Katako who was the driver to Mohammed Abacha.
Katako allegedly drove Al-Mustapha and others that day.
The family doctor of the Abiolas, Dr. Ore Falomo also testified for the prosecution.
Lawyer to the three accused persons, Mr. Olalekan Ojo entered a no-case submission on their behalf.
However, in her ruling this morning, the presiding judge, Justice Mojisola Dada said a prima facie case had not been established against CSP Rabo Lawal.
Therefore, he was acquitted and discharged.
Justice Dada further said that the prosecution’s case against Al-Mustapha and Shofolahan is sufficient enough to warrant them being called upon to defend themselves.
Consequently, 3 and 4 August, 2011 have been fixed for the accused persons to open their defence
